Right to Education


  • What it means:
    Every person — child or adult — has the right to access quality education without discrimination.
  • Why it matters: Education is the foundation for personal freedom, economic growth, and informed participation in society.
  • International protection: Article 26 of the Universal Declaration of Human Rights (UDHR); Article 13 of the International Covenant on Economic, Social and Cultural Rights (ICESCR).
  • In India: Article 21A of the Constitution makes free and compulsory education a Fundamental Right for children aged 6–14 years.
  • Violations include:
    • Denial of school admission due to caste, religion, gender, disability, or poverty
    • Poor infrastructure and untrained teachers
    • Child labour keeping children out of school

2. Freedom of Conscience and Religion

  • What it means: Every person has the freedom to hold beliefs, change their beliefs, and practice their religion (or choose none) without interference.
  • International protection: Article 18 of UDHR and ICCPR.
  • In India: Article 25 guarantees the right to freely profess, practice, and propagate religion.
  • Scope of “Conscience”: Goes beyond religion — includes moral, ethical, and philosophical beliefs.
  • Violations include:
    • Forced religious conversion
    • Discrimination based on religious identity
    • Restrictions on wearing religious symbols or following rituals

3. Freedom from Degrading Treatment or Punishment

  • What it means: No one should be subjected to torture, cruel, inhuman, or degrading treatment — whether by the state, employers, or anyone else.
  • International protection: Article 5 of UDHR, Convention Against Torture (CAT).
  • In India:
    • Article 21 (Right to life and personal liberty) interpreted by the Supreme Court to include protection from torture and inhuman treatment.
    • Various criminal laws prohibit custodial violence, assault, and inhuman punishment.
  • Examples of violations:
    • Police brutality or custodial torture
    • Public humiliation as punishment
    • Inhumane prison conditions
    • Corporal punishment in schools

हर व्यक्ति को अपनी अंतरात्मा की आवाज़ सुनने, किसी भी धर्म को मानने, बदलने या न मानने की आज़ादी है। यह स्वतंत्रता एक शांतिपूर्ण और सम्मानजनक समाज की नींव है।

🚫 अमानवीय या अपमानजनक व्यवहार से मुक्ति:
किसी भी परिस्थिति में किसी व्यक्ति को यातना, क्रूर, अमानवीय या अपमानजनक व्यवहार या सज़ा नहीं दी जानी चाहिए। यह मानव गरिमा का मूल आधार है।
