• Judicial Pronouncements: The Supreme Court has repeatedly emphasized that fair trial is part of the “basic structure” of the Constitution.

• Judicial Delays: Millions of pending cases → fair trial delayed = justice denied.
• Inequality in Access: Rich and powerful often get faster hearings, while poor undertrials spend years in jail.
• Custodial Torture & Encounters: Police sometimes bypass due process, violating Article 14 & 21.
• Media Trials: Public opinion influenced before court decision, hurting impartiality.
• Undertrials: India has a huge number of prisoners who are undertrial (not convicted, just waiting for their case to be heard).

• Pakistan: Constitution also guarantees equality and fair trial (Article 10A). But issues of military courts, political victimization, and weak judicial independence remain.
• Bangladesh: Has equality provisions, but fair trial is undermined by corruption, political interference, and weak protection against torture.
• Nepal: New Constitution (2015) recognizes equality and fair trial. Implementation is stronger than before, but judiciary still suffers from delays.
• Sri Lanka: Equality before law exists constitutionally, but human rights groups highlight problems of political interference, especially during the civil war and after.
• Bhutan & Maldives: Smaller judicial systems, fair trial rights exist on paper, but often influenced by monarchy or executive powers.

1. कानून क्या कहता है (सिद्धांत):

• भारतीय संविधान का अनुच्छेद 14 – समानता का अधिकार देता है और कहता है कि सभी नागरिक कानून के समक्ष बराबर हैं, किसी के साथ भेदभाव नहीं होगा।
• अनुच्छेद 21 – जीवन और व्यक्तिगत स्वतंत्रता का अधिकार सुनिश्चित करता है, जिसमें निष्पक्ष सुनवाई (Fair Trial) भी शामिल है।
• दंड प्रक्रिया संहिता (CrPC) और भारतीय साक्ष्य अधिनियम – मुकदमों के निष्पक्ष संचालन, अभियुक्त को वकील का अधिकार, बेगुनाही की धारणा (Presumption of Innocence) और बचाव का अवसर प्रदान करते हैं।

• ज़मीनी हकीकत – न्याय में देरी, भ्रष्टाचार, राजनीतिक प्रभाव, आर्थिक असमानता और कभी-कभी तानाशाही प्रवृत्ति इन अधिकारों को कमजोर कर देती है।

✅ यानी भारत में संविधान बेहद मज़बूत सुरक्षा देता है, लेकिन असल ज़िंदगी में आम जनता को बराबरी और निष्पक्ष न्याय पाना आज भी मुश्किल है। पड़ोसी देशों में हालात भारत जैसे ही हैं, कहीं-कहीं उससे भी ज़्यादा खराब।
